Privacy Policy Consent

This policy applies to all of the Company’s platforms and services, including our mobile application(s) (iOS and Android mobile applications), our website: http://www.prairiepump.ca (“Website”), their features, content, and other services (collectively, the “Platform” and / or the “Services”) where we are acting as a data controller with respect to the personal data of our Platform and Services users.

The Platform and Services are owned by Prairie Pump Mobile Fuel Inc. (“Company”, “our, “we”, or “us”). The term “you” refers to the user or viewer of and / or the App.

This Privacy Policy describes how we collect, use, process, and distribute your information, including Personal Data (as defined below) used to access our Platform and Services. We will not use or share your information with anyone except as described in this Privacy Policy. The use of information collected through our Platform shall be limited to the purposes under this Privacy Policy and our Terms of Service for customers.

Please read this Privacy Policy carefully. We reserve the right to change this Privacy Policy on the Platform at any time without notice. In the event of a material change, we will let you know via email and / or a prominent notice on our Platform.

Use of any personal information or contribution that you provide to us, or which is collected by us on or through our Platform is governed by this Privacy Policy. By using our Platform and Services, you consent to this Privacy Policy, whether or not you have read it.

This Policy is incorporated as part of the Company’s Terms of Service and your use of the Platform or of the Services indicates your consent to them.

Information We May Collect

We collect personal information from you so that we can provide you with a positive experience when utilizing our Platform. We will only collect the minimum amount of information necessary for us to fulfill our obligation to you. We may collect:

  1. Personal Information. Your name, address, phone number, date of birth, company name, insurance policy number, and other related information, and an email address so we can identify and contact you as necessary to fulfill our obligations to you.
  2. Billing Information. Billing information including name, address, and credit card information so that we can process payment to deliver our products or services to you under our contractual obligation.
  3. Location Data. Your geographical location, browser type and version, operating system, referral source, length of visit, page views, and Platform navigation paths, as well as information about the timing, frequency, and pattern of your service use. This may also include but is not limited to your location data, your usage data, your vehicle maintenance track record and history, your address book contacts, your communications with our subcontractors and third-party providers.
  4. Posted Information. Information that you post for publication on our Platform or through our Services.
  5. Co-branded Offer Information. Information from you from a co-branded offer. In this case, we will make clear as to who is collecting the information and whose privacy policy applies. If both / all parties are retaining the information you provide, this will also be made clear as will links to all privacy policies.
  6. Customer Information. Information relating to our customer relationships, including customer contact information.
  7. Transaction Information. Information relating to transactions, including purchases of subscriptions, goods, and services, that you enter into with us and/or through our Platform.
  8. Subscription Information. Information that you provide to us for the purpose of subscribing to our email and Platform notifications and/or promotions.
  9. Communications Information. Information contained in or relating to any communication that you send to us, including the communication content and metadata associated with the communication.
  10. Employment Information. Your employer, your job title or role, your contact details, and information contained in communications between us and you or your employer.
  11. Vehicle Information. Information relating to your car, measurements of its functions and of its driving habits. This may include, amongst other things, vehicle identification number, license plate number, vehicle information (brand/model/year/trim), its usage frequency, the trips it makes and mileage, battery status, fuel level, fuel consumption, tire pressure, towing, temperature measurements, noise, vibrations, acceleration, and deceleration.

Please note that the information above (collectively “Personal Data”) that you are giving to us is given voluntarily, and by you providing this information to us you are giving consent for us to use, collect, and process this Personal Data. You are welcome to opt-out or request for us to delete your Personal Data at any point by contacting us at admin@prairiepump.ca.

If you choose not to provide us with certain Personal Data, you may not be able to participate in certain aspects of our Platform or Services.

Other Information We May Collect

To maintain our Platform’s high quality, we may use your IP address to help diagnose problems with our server and to administer the Platform by identifying which areas of the Platform are most heavily used, and to display content according to your preferences. Your IP address is the number assigned to computers connected to the Internet. This is essentially “traffic data” which cannot personally identify you but is helpful to us for marketing purposes and for improving our services, and will form part of the Personal Data. Traffic data collection does not follow a user’s activities on any other mobile applications or websites in any way. Anonymous traffic data may also be shared with business partners and advertisers on an aggregate basis.

What We Do with Information We Collect

We may process the Personal Data you provide to us for the purpose of:

  1. Purchases. Processing your payment for purchased subscriptions, goods and services and keeping proper records of those transactions.
  2. Advertisements. Running social media advertisements and / or create look-alike audiences for advertisements.
  3. Notifications. Sending you the relevant notifications, push notifications, emails, information and/or newsletters pertaining to the Services or if we believe we have a legitimate interest to contact you based on your contact or question.
  4. Analyzing. Analyzing the use of the Platform and Services for the purposes of operating and administering our Platform, providing our services, ensuring the security of our Platform and Services, maintaining back-ups of our databases and communicating with you.
  5. Enabling. Enabling and monitoring your use of our Platform and Services.
  6. Managing Customers. Managing our relationships with customers, communicating with customers, keeping records of those communications and promoting our products and services to customers.
  7. Communication. Communicating with you to ensure you have a positive experience in using our Platform and Services.
  8. Legal Compliance. For compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
  9. Fuel Prediction. Predicting based on the fuel level, and average fuel consumption the remaining “Distance to Empty” (number of kilometers before the fuel tank is empty).

Please do not supply us with any other person’s personal data, unless we prompt you to do so.

Situations Where We May Contact or Notify You

In addition to the above, we may contact you using Personal Data that you provide to us:

  1. If you give us your clear, unambiguous, affirmative consent to contact you.
  2. We will contact you via SMS message each time you login to access our Platform and Services for the purposes of 2-factor authentication.
  3. We may contact you anytime directly though our App, or via SMS message or a telephone call for the purpose of fulfilling our contractual obligation to deliver goods or services you purchase from us.
  4. Our App will send you push notifications from time to time for the purpose of fulfilling our contractual obligation to deliver goods or services you purchase from us. This may include but is not limited to push notifications (i) confirming your order has been received, (ii) confirming your order is on route for delivery (iii) notifying you that your delivery has been delayed, cancelled or rescheduled (iv) confirming your order has been delivered and (v) any other delivery updates.
  5. We will email you a receipt for each order made using our Platform and Services in order to provide you confirmation of the details of your order, the price of your order, and the satisfactory payment thereof.To customize our Platform according to your online behavior and personal preferences.
  6. We may contact you if we feel you have a legitimate interest in hearing from us. For example, if we have a promotional sale for our products or services, we may send you marketing emails based on the content of that promotion. You will always have the option to opt out of any of our promotional emails

Providing your Personal Data to Others

  1. Affiliated Entities. We may disclose your Personal Data to any member of our group of companies (this means our subsidiaries, our ultimate holding company and all its subsidiaries) insofar as reasonably necessary for the purposes, and on any legal or contractual basis.
  2. Insurance. We may disclose your Personal Data to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
  3. Suppliers and Contractors. We may disclose your Personal Data to our suppliers or subcontractors insofar as reasonably necessary for the provision of the Platform and Services. We may disclose your Personal Data to one or more of those selected third party suppliers of goods and services identified on our Platform for the purpose of enabling them to contact you so that they can offer, market and sell to you relevant goods and/or services. Each such third party will act as a data controller in relation to the enquiry data that we supply to it; and each such third party has its own privacy policy, which will govern that third party’s use of your personal data. We advise you to read carefully those third parties’ privacy policies.
  4. Payment Service Providers. Financial transactions relating to our Platform and Services are handled by our third-party payment service providers. The Company will decide which one the payment service providers the user should use. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. We will never store any personal credit card data on our servers.
  5. Legal. We may disclose your Personal Data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

Viewing by Others

Note that whenever you voluntarily make your Personal Data available for viewing by others online through our Platform or Services, it may be seen, collected and used by others, and therefore, we cannot be responsible for any unauthorized or improper use of the information that you voluntarily share (i.e., sharing a comment on a blog post, posting in a Facebook group that we manage, sharing details on a group correspondence, etc.).

Submission, Retention, Storage, Sharing and Transferring of Personal Data

Personal Data that you provide to us is stored internally or through a data management system. Your Personal Data will only be accessed by those who help to obtain, manage or store that information, or who have a legitimate need to know such Personal Data (i.e., our hosting provider, newsletter provider, payment processors or team members).

Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes, including providing you our Platform and Services.

We retain your Personal Data for the minimum amount of time necessary to provide you with the information and / or services that you requested from us. We may include certain Personal Data for longer periods of time if necessary for legal, contractual and accounting obligations.

Notwithstanding the other provisions of this Section, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Confidentiality

We aim to keep the Personal Data that you share with us confidential. Please note that we may disclose such information if required to do so by law or in the good-faith belief that:

  1. Such action is necessary to protect and defend our rights or property or those of our users or licensees;
  2. To act as immediately necessary in order to protect the personal safety or rights of our users or the public; or
  3. To investigate or respond to any real or perceived violation of this Privacy Policy or of our Disclaimer, Terms of Services, or any other terms of service or agreement with us.

Passwords

To use certain features of the Platform, you may need a username and password. You are responsible for maintaining the confidentiality of the username and password, and you are responsible for all activities, whether by you or by others, that occur under your username or password and within your account. We cannot and will not be liable for any loss or damage arising from your failure to protect your username, password or account information. If you share your username or password with others, they may be able to obtain access to your Personal Data at your own risk.

You agree to notify us immediately of any unauthorized or improper use of your username or password or any other breach of security. To help protect against unauthorized or improper use, make sure that you log out at the end of each session requiring your username and password.

We will use our best efforts to keep your username and password(s) private and will not otherwise share your password(s) without your consent, except as necessary when the law requires it or in the good faith belief that such action is necessary, particularly when disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to others or interfering with our rights or property.

Your Rights

In this Section, we have summarized the rights that you have under data protection law. Some of the rights are complex, and not all of the details have been included in our summaries. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights. You have the right to:

  1. Profile Information. You can review and edit certain account information you have chosen to add to your profile by logging in to your account settings and profile.
  2. Opting out of receiving electronic communications from us. If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with our Services.
  3. Cookie Tracking. If the Platform or Services use cookies, you can modify your cookie settings on your browser, but if you delete or choose not to accept our cookies, you may be missing out on certain features of the Platform.
  4. Do Not Track. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services that you do not want them to track your online activities. The Platform does not currently support Do Not Track requests at this time.
  5. Deleting Your Account. If you would like to delete your account, please contact the Company through the email or the phone provided herein or on the Website. In some cases, we will be unable to delete your account, such as if there is an issue with your account related to trust, safety, or fraud. When we delete your account, we may retain certain information for legitimate business purposes or to comply with legal or regulatory obligations. For example, we may retain your information to resolve open insurance claims, or we may be obligated to retain your information as part of an open legal claim. When we retain such data, we do so in ways designed to prevent its use for other purposes.
  6. Request Information. Request information about how your Personal Data is being used and request a copy of what Personal Data we use.
  7. Restrict the use of your Personal Data. Restrict processing if you think the Personal Data is not accurate, unlawful, or no longer needed.
  8. Consent. Where the processing of your personal data is based on your previously given consent, you have the right to withdraw your consent at any time. You may also have the right to object to the processing of your personal data on grounds relating to your particular situation.
  9. Lodge a Complaint. Lodge a complaint with a supervisory authority if you feel we are using your Personal Data unlawfully.
  10. To See or Change Your Account Personal Data. If you would like to review, correct, or update personal data that you have previously disclosed to us, you may do so by signing into your account or by contacting us.
  11. Automated Decisions. Not be subject to an automated decision based solely on automatic processing, including profiling, which legally or significantly affects you.
  12. Export to Another Company: You have the right to request that we export, where technically feasible, your personal data that we hold in order to provide the Platform and Services to another company.

For your protection, we may need to verify your identity before responding to your request with respect to exercising any of your rights herein, such as verifying that the email address from which you send the request matches your email address that we have on file. If we no longer need to process personal data about you in order to provide our Platform and Services, we will not maintain, acquire or process additional information in order to identify you for the purpose of responding to your request.

Process For Exercising Data Protection Rights

In order to exercise your data protection rights, you may contact the Company as described in the Our Details section below. We take each request seriously. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your Personal Data. If you feel that you have not received a satisfactory response from us, you may consult with the data protection authority in your country. If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection.

Unsubscribe

Security

We take commercially reasonable steps to protect the Personal Data you provide to us from misuse, disclosure or unauthorized access. We only share your Personal Data with trusted third parties who use the same level of care in processing your Personal Data. That being said, we cannot guarantee that your Personal Data will always be secure due to technology or security breaches. Should there be a data breach of which we are aware, we will inform you immediately.

Anti-Spam Policy

We have a no spam policy and provide you with the ability to opt-out of our communications by selecting the unsubscribe link at the footer of all e-mails. We have taken the necessary steps to ensure that we are compliant with applicable legislation by never sending out misleading information. We will not sell, rent or share your email address.

Third Party App and / or Websites

We may link our Platform to other websites, mobile applications or platforms. We have no responsibility or liability for the content and activities of any other individual, company or entity whose platform or materials may be linked to our Platform, and thus we cannot be held liable for the privacy of the information on their website or other platform or that you voluntarily share with their website or other platform. Please review their privacy policies for guidelines as to how they respectively store, use and protect the privacy of your Personal Data.

Children’s Online Privacy Protection Act Compliance

We do not collect any information from anyone under 18 years of age in compliance with COPPA (Children’s Online Privacy Protection Act) and the GDPR (General Data Protection Regulation of the EU). Our Platform and Services our directed to individuals who are at least 18 years old or older.

Amendments

We may update this policy from time to time by publishing a new version on our Platform. You should check this page occasionally to ensure you are happy with any changes to this policy.

Notification of Changes

We may use your Personal Data, such as your contact information, to inform you of changes to the Platform or Services, or, if requested, to send you additional information about us. We reserve the right, at our sole discretion, to change, modify or otherwise alter our Platform, its content and this Privacy Policy at any time. Such changes and/or modifications shall become effective immediately upon posting our updated Privacy Policy. Please review this Privacy Policy periodically. Continued use of any of information obtained through or on the Platform following the posting of changes and/or modifications constituted acceptance of the revised Privacy Policy. We are the data controllers as we are collecting and using your Personal Data. We use trusted third parties as our data processors for technical and organizational purposes, including for payments and email marketing.
